Canada’s Spousal Open Work Permit (SOWP) program allows eligible spouses or common-law partners of certain international students and foreign workers to work in Canada without being tied to a specific employer. However, an important feature of the program has recently sparked discussion about whether the rules could potentially be misused.

According to Immigration, Refugees and Citizenship Canada (IRCC), an already-issued spousal open work permit can normally remain valid until its original expiry date even when certain circumstances change after approval. This may include situations where the principal applicant loses their job, completes their studies earlier than expected, or the couple later separates or divorces.

While this policy protects genuine families facing unexpected life changes, concerns have been raised about whether some applicants could deliberately create qualifying circumstances solely to obtain a Canada open work permit.

What Is the Spousal Open Work Permit Concern?

The key issue is the difference between eligibility at the time an application is approved and events that happen afterward.

A spouse may qualify for a Spousal Open Work Permit in Canada because their partner is studying in an eligible program or working in a qualifying occupation. Once the permit has been issued, a subsequent change in circumstances does not necessarily cancel the permit immediately.

For genuine families, this approach provides important stability. For example, a foreign worker may unexpectedly lose their job, a student may finish a program early, or a genuine relationship may unfortunately break down.

In these situations, automatically cancelling the spouse’s work authorization could create significant hardship.

However, concerns arise when someone allegedly enters into a relationship, enrols in studies, or accepts employment without genuinely intending to maintain the qualifying circumstances.

Genuine Changes vs. Immigration Misrepresentation

It is important not to confuse a legitimate change of circumstances with Canadian immigration misrepresentation.

If an applicant truthfully provides accurate information and their circumstances genuinely change after approval, the existence of that change does not automatically mean immigration fraud.

Canada Has Already Tightened SOWP Eligibility

Canada significantly narrowed Spousal Open Work Permit eligibility in January 2025.

For international students, eligibility is generally restricted to spouses of students enrolled in qualifying master’s programs of at least 16 months, doctoral programs, and certain designated professional programs.

Spouses of students enrolled in many regular college diploma, certificate, and undergraduate programs generally no longer qualify under the broader rules that previously existed.

For foreign workers, eligibility is generally connected to the principal applicant working in TEER 0 or TEER 1 occupations, as well as certain selected TEER 2 and TEER 3 occupations linked to labour shortages and government priorities.

Additional requirements and exceptions may apply depending on the worker’s immigration category and pathway.

What Happens When the Existing Permit Expires?

An important point for SOWP holders in Canada is that continued validity is not the same as guaranteed renewal.

If the principal applicant no longer meets the qualifying conditions when the spouse’s permit expires, the spouse may not be eligible to extend the same type of spousal open work permit.

They may, however, qualify for another immigration option depending on their individual circumstances.

This makes proper long-term planning extremely important for temporary residents who hope to eventually obtain Canada Permanent Residency (PR).

Genuine applicants should not panic because of online discussions surrounding potential misuse of the program.

The best approach is to ensure that all information submitted to IRCC is truthful, complete, and supported by appropriate documentation.

Applicants should carefully document their genuine relationship, ensure that the principal applicant meets the applicable eligibility requirements, and avoid relying on misleading immigration advice found online.
