Immigration, Refugees and Citizenship Canada (IRCC) has recently announced an extension of its policy to offer open work permits (OWPs) to eligible provincial nominee program (PNP) candidates. This temporary public policy, now extended until December 31, 2025, provides foreign nationals with OWPs that are valid for up to two years, opening new pathways for work and settlement in Canada.
Understanding the New Policy
The expanded policy allows PNP candidates with a valid expression of interest (EOI) profile from a participating province or territory to apply for an open work permit. To qualify, applicants must also secure a support letter from the respective provincial or territorial immigration authority. This letter confirms their inclusion in the EOI pool and serves as a crucial part of the application process.
Eligible candidates must meet one of three specific situations:
- Valid Work Permit Holders: Those who already possess a valid work permit.
- Expired Work Permit Holders with Extension Applications: Individuals whose work permits expired after May 7, 2024, but who have applied for an extension or restoration of status.
- Maintained Status Applicants: Candidates who had maintained their status on the basis of an extension application submitted prior to May 7, 2024, and whose application is either approved or pending.
Additionally, applicants are required to provide a letter of employment from their current employer and a support letter from the province or territory in which they reside and work.
Participating Provincial Nominee Programs (PNPs)
As of now, three PNPs have joined this temporary public policy by issuing work permit support letters:
- Alberta Advantage Immigration Program (AAIP)
- Manitoba Provincial Nominee Program (MPNP)
- Yukon Nominee Program (YNP)
Each province or territory may have slight variations in the process, and the issuance of the support letter is entirely at the discretion of the respective provincial immigration authority.
How to Apply for an Open Work Permit
If you meet the eligibility criteria, follow these steps to apply for an OWP under this policy:
- Gather Required Documents:
Ensure you have a valid passport, digital copies of your documents (using a scanner or camera), and a valid credit or debit card for payment. - Review the Instruction Guide:
Before filling out the application, carefully read the detailed instruction guide provided by IRCC. If you need to restore your status, indicate this clearly on form IMM 5710 under the “Restore my status as a worker” option. - Understand the Fee Structure:
Be prepared to pay processing fees which may include:- Work Permit Fee: CAD 155
- Open Work Permit Holder Fee: CAD 100
- Restoration of Status Fee (if applicable): CAD 239.75
- Access Your IRCC Secure Account:
Sign in or create an IRCC Secure Account online to submit your application, pay fees, and track your application’s status. - Obtain a Personalized Document Checklist:
Once logged in, answer a few preliminary questions to receive a tailored checklist of the required documents, including your support letter, current work permit (if applicable), and employment letter. - Complete and Submit Your Application:
Fill out the work permit application form, ensuring you select “Open Work Permit” in the relevant section and include the correct provincial code (e.g., ABEOI2024 for Alberta, MBEOI2024 for Manitoba, or YKEOI2024 for Yukon). Upload all the necessary documents and follow the online instructions carefully.
Why Open Work Permits Are Beneficial
Open work permits offer significant advantages compared to closed or employer-specific permits. They provide the flexibility to work for most employers across a wide range of industries, making them highly desirable for newcomers. This flexibility is especially valuable as it allows candidates to transition more smoothly to permanent residency through various PNP streams, aligning with the federal government’s goal of increasing the rate of permanent residents over temporary residents.
Moreover, the policy simplifies the transition process for skilled workers by reducing administrative hurdles and offering a clear, supportive pathway toward long-term settlement in Canada.
