Canada is currently experiencing one of the largest waves of temporary resident status changes in its immigration history. According to recent IRCC data, more than 314,000 work permits are expected to expire between January and March 2026, leaving many temporary workers uncertain about their future in the country.
For thousands of foreign workers and international graduates, this moment could determine whether they transition toward Permanent Residency in Canada or prepare to leave the country. Understanding your options early can make the difference between staying legally in Canada or losing your status.
Why So Many Work Permits Are Expiring in 2026
The surge in expiring permits is largely tied to Canada’s post-pandemic immigration strategy. During 2022–2024, Canada issued record numbers of work permits through programs such as the International Mobility Program (IMP) and the Temporary Foreign Worker Program (TFWP).
As a result, many of those permits are now reaching their expiry dates simultaneously.
Estimates suggest:
-
314,000+ permits expire between January and March 2026
-
Around 770,000 permits may expire by mid-2026
-
Nearly 1.4 million work permits could expire throughout the entire year
This means thousands of workers will soon need to find new ways to remain in Canada legally.
Who Is Most Affected by the Expiry Wave
The majority of expiring permits belong to two main groups:
1. Post-Graduation Work Permit (PGWP) Holders
International students who graduated from Canadian institutions often rely on the PGWP to gain Canadian work experience and eventually qualify for Express Entry or Permanent Residency in Canada.
2. Spousal Open Work Permit (SOWP) Holders
Spouses of international students or foreign workers can work in Canada through Spousal Open Work Permits. However, these permits are typically linked to the primary applicant’s status.
If the principal permit expires, the spouse’s ability to work in Canada may also be affected.
What Happens When a Work Permit Expires
When a Canada work permit expires, individuals generally fall into one of four scenarios.
1. Applying for a Work Permit Extension
Workers who still meet eligibility requirements may apply for a work permit extension before their current permit expires. If submitted on time, applicants may remain in Canada while their application is processed.
2. Maintained Status (Previously Known as Implied Status)
If you apply for an extension before the permit expires, you may remain in Canada under maintained status. This allows you to continue working under the same conditions while waiting for a decision.
However, leaving Canada during this period can cancel your maintained status.
3. Restoration of Status
If the permit expires before an extension application is submitted, workers have 90 days to apply for restoration of status.
During this period:
-
You cannot work
-
You must submit a restoration request and pay additional government fees
-
Approval is not guaranteed
4. Leaving Canada
Some temporary residents may need to leave Canada if they cannot secure another status or immigration pathway.
Canada’s immigration levels plan currently offers fewer Permanent Residency spots than the number of expiring permits, which means not everyone will qualify for PR immediately.
Immigration Pathways for Workers with Expiring Permits
If your work permit in Canada is expiring, several legal options may help you remain in the country.
Express Entry – Canadian Experience Class
Workers with at least one year of skilled Canadian work experience may qualify for the Canadian Experience Class (CEC) under Express Entry Canada.
Provincial Nominee Programs (PNPs)
Many provinces offer immigration streams for workers already employed locally. A Provincial Nomination adds 600 CRS points, significantly improving the chances of receiving an Invitation to Apply (ITA).
Bridging Open Work Permit (BOWP)
Applicants who have already submitted a Permanent Residency application may qualify for a Bridging Open Work Permit, allowing them to keep working while waiting for a PR decision.
LMIA-Based Work Permits
Employers can support workers through a Labour Market Impact Assessment (LMIA), which may allow them to obtain a new employer-specific work permit.
Strategic Return and Re-Application
In some cases, individuals choose to leave Canada temporarily, gain additional foreign work experience, and reapply for Express Entry Canada PR with a stronger profile.
Important Deadlines to Remember
Temporary workers should be aware of the following timelines:
-
Before permit expiry: Apply for extension to maintain status
-
Within 90 days after expiry: Apply for restoration of status
-
Express Entry draws: Continue monitoring invitations for Canadian Experience Class and targeted occupations
Acting early is essential to avoid falling out of status.
